Terms of use

These terms govern your use of this website. They are not the contract for any engagement — that is a separate written agreement, and where the two differ, the engagement agreement governs.

The website is provided as it is

We take care to keep this site accurate and available, but we do not warrant that it will be uninterrupted, error-free, or that anything on it is complete or current. Nothing here is professional advice, and nothing here is an offer capable of acceptance.

Limitation of liability

To the fullest extent the law allows, Noir Echelon is not liable for any indirect, incidental, special or consequential loss arising from your use of this website, including lost profits, lost data or business interruption, whether or not we were advised such loss was possible.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

Timings, prices and figures

Any timeframe, price range or performance figure published on this site is indicative and describes what is typical, not what is promised. What you are owed on a project is set out in that project's written scope and price, agreed before work begins.

Work shown here

Projects are published to describe work carried out. Client names, logos and trade marks remain the property of those businesses and appear here to identify the work, not to imply that they endorse or are affiliated with anything beyond that engagement. If you are a client and would like your project removed, write to us and we will take it down.

Where a case study describes an outcome, it describes what was delivered. Nothing here should be read as a prediction of results for anyone else.

Our material

The design, code, text and images on this site, other than client material and third-party fonts, belong to Noir Echelon. You may view and share pages; you may not copy the site or substantial parts of it for your own commercial use without permission.

Typefaces are used under the SIL Open Font License, and their licences are distributed with them.

What you send us

When you submit an inquiry you confirm the information is yours to send and is accurate. Do not send confidential material through the form before we have an agreement in place. How we handle what you send is set out in the privacy notice.

Where this site links to another, we are not responsible for that site's content, availability or handling of your data.
